§ 112.03  CLASSIFICATION AND DISTANCE RESTRICTIONS.
   (A)   No more than 1 classification of sexually oriented business can be operated in any 1 permitted premises.
   (B)   No person shall cause or permit the establishment of any sexually oriented businesses, as defined under this chapter except within any I-1, Light Industrial District or POI, Planned Office/Industrial District as defined in § 154.053 and § 154.056(M) of the Tipp City Zoning Code. Nothing in this chapter requires the issuance of a zoning certificate for the issuance of a permit to operate a sexually oriented business. However, the permitted premises must be located in the I-1. Light Industrial District or the POI, Planned Office/Industrial District. Any zoning requirements imposed by the city are independent of the requirements of this chapter. Further, no permitted premises of a sexually oriented business may be located within 1,000 feet of the permitted premises of another such sexually oriented business; or, within 1,000 feet of the grounds of any school, library, public park or recreation area, church or church grounds, or residential district or use; or, within 750 feet of the right-of-way of any divided, limited access highway including but not limited to applicable portions of Interstate 75.
