§ 110.99  PENALTY.
   Whoever violates any provision of this chapter is guilty of engaging in prohibited solicitation.
   (A)   Except as otherwise provided in division (B) of this section, engaging in prohibited solicitation is a misdemeanor of the fourth degree.
   (B)   If within 1 year, the offender previously has been convicted of or pleaded guilty to a violation of engaging in prohibited solicitation or any substantially equivalent municipal ordinance of another jurisdiction, engaging in prohibited solicitation shall be a misdemeanor of the first degree.
