§ 96.01  PUBLIC USE OF PARKS AND NATURE AREAS.
   No person shall do any of the following acts within or upon any public parks or nature areas of the city, including but not limited to the Tipp City Park, the Tipp City Nature Area, Hathaway Park, the canoe livery, or the gravel pits adjacent to State Route 571 east of the city:
   (A)   Enter, use, or remain upon the parks or nature areas between the hours of 11:00 p.m. and 5:00 a.m., except for persons who, after prior notice to the Police Division, are actively engaged in fishing.  The Parks Advisory Board may also authorize other exceptions to the park hours on a specific case-by-case basis for legitimate recreational uses.  In considering such requests, the Parks Advisory Board may condition approval upon certain requirements necessary to ensure the safe and appropriate use of the subject park land and may also attach reasonable fees to said use to compensate the city for any extraordinary expenses associated with such use.  Nothing herein shall be construed as authorizing a continuing or permanent waiver of the park hours contained in this provision.
   (B)   Possess or consume any alcoholic beverage.
   (C)   Operate or park any motor vehicle, motor scooter, motorcycle, moped, bicycle, or all-terrain vehicle in or upon any portion of a park or nature area not designated as a park drive, roadway, or parking area.
   (D)   Operate any motor vehicle, motor scooter, motorcycle, moped, bicycle, or all-terrain vehicle in excess of 8 miles per hour.
   (E)   Operate any snowmobile or unlicensed motor vehicle.
   (F)   Swim or bathe in any waters within or adjacent to any park, nature area, or canoe livery.
   (G)   Establish or maintain any camp, tent, or other temporary lodging or sleeping place not designated by the city.
   (H)   Discharge any firearm, air rifle, slingshot, or bow.
   (I)   Engage in any ice skating.
   (J)   Enter or remain upon any area designated and marked for Police Division personnel only.
   (K)   Possess any firearm, air rifle, slingshot, or bow, except as said person is specifically qualified and permitted to carry a concealed handgun by the State of Ohio, as set forth in the Ohio Revised Code.
   (L)   Knowingly possess a deadly weapon inside the Tipp City Community Athletic Field, inside the building known as the “Roundhouse”, inside the building known as the “Band Boosters Building”, inside the restrooms adjacent to the Tipp City Community Athletic Field, or in the parking facilities adjacent to the Tipp City Community Athletic Field during any school activity as defined in the Ohio Revised Code.
