§ 55.29  MUNICIPAL BILLING PROVISIONS.
   (A)   A bill for garbage, refuse, and recycling services will be issued each month. This will be for trash service the following month. (In other words, billed in advance.) The bill will be due and payable by the 10th of each month. A combined water, sewer, electric, garbage, refuse and recycling bill will be issued.
   (B)   Charges covering less than a full billing period shall be prorated based on the number of days serviced within a month. Garbage, refuse, and recycling will be pro-rated weekly. An account having service for 6 days or less within 1 month will not be charged for garbage, refuse, and recycling, an account having service for 7 to 10 days will be charged 1/4 of the current rate, an account having service for 11 to 17 days will be charged ½ of the current rate, an account having service for 18 to 24 days will be charged 3/4 of the current rate, and any account having service for 25 days or more will be billed the full amount.
   (C)   The municipality shall endeavor to give proper notice of garbage, refuse, and recycling charges, but by law cannot guarantee delivery of mail. Failure to receive notice by mail shall not excuse customers from prompt payment of charges.
   (D)   All garbage, refuse, and recycling charges are payable at the Tipp City municipal utility office, or other locations as noted on the Tipp City municipal utility bill.
   (E)   Garbage, refuse, and recycling charges shall be credited first on the combined utility bill.
   (F)   The garbage, refuse and recycling bill will be sent to the same person, individual, firm or corporation within the corporate limits who receives the electric, water, and sewer bill. In the event the landlord wishes to pay for garbage, refuse, and recycling charges for a lot, parcel of land, building, or premises, a separate account my be established upon receiving written authorization from the landlord. Once this charge has been established it will stay in effect until a new owner requests in writing to have the garbage, refuse, and recycling charged to the tenant.
   (G)   The monthly residential garbage, refuse, and recycling rate shall be:

   (I)   The municipality shall pay the residential permittee once per month, based upon a mutually acceptable bill for customers served. The franchise fee shall be deducted from the monthly payment to the residential permittee.
   (J)   The non-payment of garbage, refuse, and recycling charges will constitute a utility bill delinquency and the electric will be subject to termination in accordance with the Electric Rules and Regulations section 22 and 23.
