§ 5.02  POWERS AND DUTIES OF THE MUNICIPAL MANAGER.
   The Municipal Manager shall be the chief administrative officer of the municipality.  The Municipal Manager shall be responsible to the Council for the administration of all municipal affairs placed in the Manager's charge by or under this Charter.  The Manager shall have the following powers and duties:
   (A)   The Manager shall appoint and, when deemed necessary for the good of the service, suspend or remove any municipal employees or appointive administrative officers provided for by or under this Charter, except as otherwise provided by this Charter or personnel rules adopted pursuant to this Charter.  The Manager may authorize any administrative officer who is subject to the Manager's direction and supervision to exercise these powers with respect to subordinates in that officer's department, office, or agency.
   (B)   The Manager shall direct and supervise the administration of all departments, offices, and agencies of the municipality, except as otherwise provided by Charter, or by Council as authorized by Charter.
   (C)   The Manager shall attend all Council meetings unless excused by Council, and he shall have the right to take part in discussion, but may not vote.
   (D)   The Manager shall see that all laws, provisions of this Charter, and acts of the Council, subject to enforcement by the Manager or by officers subject to the Manager's direction and supervision, are faithfully executed.
   (E)   The Manager shall submit to the Council and make available to the public in the manner as determined by ordinance or resolution of Council a complete report on the finances and administrative activities of the municipality at the end of each fiscal year.
   (F)   The Council may require the Manager to present an annual inventory of all municipal property, both real property and personal property.
   (G)    The Manager shall make such other reports as the Council may require concerning the operations of municipal departments, offices, and agencies subject to the Manager's direction and supervision, and the Manager shall make such recommendations to the Council concerning the affairs of the municipality as the Manager deems desirable.
   (H)   The Manager shall prepare and submit the annual budgets and capital program to the Council, and keep the Council fully advised as to the financial condition and future needs of the municipality.
   (I)   The Manager shall prepare all contracts in cooperation with the Director of Law.  No contract, agreement, or franchise shall be legal until ratified by ordinance or resolution of Council, provided that the Council may authorize the Manager to make purchases and enter into contracts without Council approval, provided such purchases or contracts do not exceed an amount to be established by ordinance or resolution.
   (J)   The Manager shall perform such other duties as are specified in this Charter or may be required by Council under its Charter authority.
   (K)   The Manager shall have authority in time of emergency, so declared by the Manager, to utilize the services and equipment of any and all municipal departments, agencies, and their employees as directed by the Manager to perform necessary functions of the municipality, regardless of their location or position or their assignment in any department or agency over which the Manager has administrative authority.  Any employee who determines that the emergency assignment is beyond the Manager's competence shall immediately file an objection in writing, directly, with the Municipal Manager, who shall consider such objection, or objections, before making final determination. The use of this emergency authorization by the Municipal Manager shall be reported by the Manager to the Council at its meeting next following the use thereof.
