§ 37.33  VACATIONS.
   (A)    Full-time and permanent part-time employees shall, after completion of their evaluation period or six months of continuous service with the city, whichever is greater, will be credited with vacation leave with pay according to their number of years of continuous service with the employer.  Employees hired after July 5, 1987 shall be credited with a percentage of prior service with any Ohio political subdivision as follows:
 
Years of prior public service completed with the state or an Ohio political subdivision
% of years recognized toward city vacation credit
First 5 years
100% (full credit)
Next 15 years
50% (half credit)
21 or more years
0% (no credit)
 
   (B)   Vacation leave shall be credited to employees on an accrual basis per pay period according to the following schedule.
 
Bi-Weekly Entitlement
After completion of probationary period or 6 months,  whichever is greater
3.08 hours
After completion of 6 years, service
4.62 hours
After completion of 13 years, service
6.15 hours
After completion of 22 years service
7.69 hours
 
   (C)   Vacation leave shall normally be taken by an employee within one year of the date of accrual. An employee shall not, at any time, accumulate more than one and one-half times their annual vacation rate. Any vacation time accrued in excess of one and one-half times their annual vacation rate will be forfeited. Employees covered by this chapter who earn a minimum of four weeks of vacation in one year, may, cash in for pay, one week, 40 hours, of the earned vacation. The employee must submit the appropriate paperwork to the payroll department to cash in for pay any earned vacation and do so within the calendar year said vacation was earned.
   (D)   All vacations shall be approved by the department director based upon departmental needs. When multiple vacation requests are received for the same date range, the first request received by the department director will be given preference. Should more than one request be received at the same time for the same date, seniority shall prevail.
   (E)    Earned vacation leave shall run concurrent with Family Medical Leave if the employee has exhausted all his or her sick leave.
   (F)   A permanent part-time employee shall only receive vacation leave with pay, based upon their regularly scheduled hours of work. Overtime hours shall not count towards vacation time hours.
