§ 37.05  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning or due to changes in the law.
   ACTIVE PAY STATUS.  Active pay status shall mean condition under which an employee is eligible to receive pay directly from the city which includes vacation, sick leave, holidays, military leave, and paid court leave.
   AT-WILL.  Either the employer or employee may terminate the employment relationship at any time for any reason.
   ANNIVERSARY DATE.  The date upon which an employee successfully completes his or her evaluation period and becomes permanent.  Employees eligible for merit based pay increases will be eligible for said increases on their anniversary date unless otherwise approved by the City Manager.
   CONVICTION.  Any finding of guilt, including a plea of no contest, or the imposition of a sentence, or both, by any judicial body charged with the responsibility to determine violations of the federal or state criminal statutes.
   FULL-TIME EMPLOYEE.  An employee of the city regularly scheduled and expected to work 40 hours per week or more on a year-round basis and entitled to certain fringe benefits such as paid health insurance, sick leave, holidays, vacation, personal days, and the like.
   IMMEDIATE FAMILY.  A spouse (as defined by law), parents and stepparents, children and stepchildren, grandparents, brother, sister, grandchildren, brother-in-law, sister-in-law, daughter-in-law, son-in-law, mother-in-law, father-in-law, or other person who stands in place of a parent (loco parentis), or other relative residing in the same household as the employee.
   PART-TIME EMPLOYEE.  An employee of the city who does not work a regular shift and is
scheduled based on availability (i.e. EMS) and works less than 30 hours per week and is not entitled to fringe benefits unless otherwise provided for herein or by law.
   PERMANENT PART-TIME EMPLOYEE. An employee of the city, who works a regularly scheduled time of less than 30 hours per week on a year-round basis and may be entitled to fringe benefits unless otherwise provided for herein or by law.
   PUBLIC ACCOUNTABILITY.  Being trusted with the public resources, to be answerable to the fiscal and the social responsibilities that have been assigned to them.
   SALARIED EMPLOYEE.  An employee who meets the requirements of the Fair Labor Standards Act (FSLA) as being exempt from the overtime provision of the Act and is not paid on a per hour basis, but expected to work no less than 40 hours a week, Monday through Friday.
   SEASONAL EMPLOYEE.  An employee of the city who is scheduled or expected to work in conjunction with certain specific municipal operations, seasonal in nature, such as but not limited to, grass cutting, swimming pool operations, snow removal and leaf pick-up, and is not entitled to fringe benefits.  Such employees shall be limited to 160 days worked per calendar year and up to 40 hours per week.
   START DATE.  The date an employee begins employment with the city.
   TEMPORARY EMPLOYEE. An employee of the city who may be scheduled to work up to 40 hours per week, but for a time period of less than 90 consecutive working days and is not entitled to fringe benefits unless otherwise provided by law.
