(1) The purpose of the overlay districts established in this section is to provide for additional guidance and protections of some of the city's special resources including, but not limited to, the Old Tippecanoe City area (a.k.a. downtown Tipp City), special flood hazard areas as determined by FEMA, and the areas surrounding the city's wellheads.
(2) Determination of Applicability
It shall be the responsibility of any person owning real property and/or owning or operating a business within the city to make a determination of the applicability of this section as it pertains to the property and/or business, and failure to do so shall not excuse any violations of this section.
