ORDINANCE NO. 4-10

   AN ORDINANCE ADOPTING A REVISED CODIFICATION OF THE TIPP CITY MUNICIPAL CODE

   WHEREAS, Section 4.17(B) of the Tipp City Charter requires that the City Council periodically "provide for the preparation of a general codification of all ordinances and resolutions having the force and effect of law," that the general codification be adopted by ordinance, and that the general codification be "published promptly in bound or looseleaf form, together with [the] Charter and any amendments thereto, pertinent provisions of the Constitution and other Laws of the State of Ohio, and such codes of technical regulations and other rules and regulations as the Council may specify"; and

   WHEREAS, Section 4.17(B) of the Tipp City Charter further requires that copies of the general codification "be furnished to municipal officers, placed in libraries and public offices for free public reference, and made available for purchase by the public at the reasonable price fixed by the Council"; and

   WHEREAS, the Tipp City Municipal Code (the "Code") has been amended, corrected and otherwise revised since the publication of its last general codification in 2006; and

   WHEREAS, the published edition of the last codification of the Code does not include those amendments, corrections and other revisions contained in the "2009 Supplements," which consist of the "2009 S-1 Supplement," attached and incorporated as Exhibit "A," and the "2009 S-2 Supplement," attached and incorporated as Exhibit "B"; and

   WHEREAS, the 2009 Supplements to the Code contain amendments, corrections and other revisions that have been duly enacted pursuant to the Ohio Constitution, the Ohio Revised Code and the Tipp City Charter, and thereby have acquired the full force of law;

   NOW, THEREFORE, THE MUNICIPALITY OF TIPP CITY HEREBY ORDAINS:

   Section 1.  That the general ordinances of the City of Tipp City, as presently compiled and codified, and as modified by the 2009 Supplements, are hereby adopted as the "Tipp City Municipal Code."

   Section 2.  That the Tipp City Municipal Code, as adopted pursuant to Section 1, shall be deemed published as of the date on which this Ordinance becomes law.

   Section 3.  The Clerk of the City of Tipp City is hereby authorized and ordered to file a copy of the Tipp City Municipal Code, as adopted pursuant to Section 1, in the Office of the Clerk, and to distribute and furnish copies of the same as required by § 4.17(B) of the Tipp City Charter.

   Section 4.  That this Ordinance shall be in full force and effect from and after the earliest period allowed by law.
