§ 81.05 DETERMINATION OF VIOLATION BY TECHNICIAN.
Before a citation may be issued for any automated traffic law violation, a determination must be made by a technician employed or contracted by the village that, based on inspection of recorded images generated by the system, the motor vehicle was being operated in violation of § 11-306 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5 § 11-306), or similar provision of this village code, as described in ILCS Ch. 625, Act 5 § 11-208.6. If the technician determines that the vehicle entered the intersection as part of a funeral procession or in order to yield the right-of-way to an emergency vehicle, a citation shall not be issued. Nor shall a citation issue where a motor vehicle comes to a complete stop and does not enter the intersection, as defined by ILCS Ch. 625, Act 5 § 1-132, during the cycle of the red signal indication unless one or more pedestrians or bicyclists are present, even if the motor vehicle stops at a point past a stop line or crosswalk where a driver is required to stop. All determinations by a technician that an automated traffic law violation occurred must be reviewed and approved by a law enforcement officer or retired law enforcement officer of the village prior to a citation being issued.
