§ 37.07 FEES.
   (A)   The village shall charge fees reasonably calculated to reimburse its actual cost for reproducing and certifying public records and for the use, by any person, of the village’s equipment to copy records.
   (B)   For records produced in electronic format, the village shall charge the requester for the actual cost of purchasing the recording medium, whether disc, diskette, tape, or other medium. Any statutory fees applicable to copies of records when furnished in paper format shall not be applicable to those records when furnished in electronic format.
   (C)   No fees shall be charged for the first 50 pages of black and white, letter or legal sized copies requested by a requester. The fee for black and white, letter or legal sized copies beyond the first 50 pages shall be 15 cents per page, or such higher amount as may be allowed by law.
   (D)   If records are produced in color or in a size other than letter or legal, the village shall charge its actual cost for reproducing the records.
   (E)   No fee shall be charged for the cost of any search for and review of the records or other personnel costs associated with reproducing the records except for any costs relating to a search (request) for a commercial purpose and also except as provided in division (H) below.
   (F)   The cost for certifying a public record shall be $1 per record.
   (G)   Fees may be reduced or waived by the village if the village determines that a waiver or reduction of fees is in the public interest as determined under the Act and based on the stated purpose of the request.
   (H)   The village may charge up to $10 for each hour spent by personnel in searching for and retrieving a requested record for a commercial purpose. No fees shall be charged for the first eight hours spent by personnel in searching for or retrieving a requested record. The village may charge the actual cost of retrieving and transporting public records from an off-site storage facility when the public records are maintained by a third-party storage company under contract with the village. If the village imposes a fee pursuant to this division (H), it must provide the requester with an accounting of all fees, costs, and personnel hours in connection with the request for public records. The provisions of this division (H) apply only to requests for a commercial purpose.
