§ 35.20 PARTICIPATION BY CERTAIN RETIRED VILLAGE PERSONNEL IN VILLAGE’S HEALTH INSURANCE PLAN.
   (A)   All full-time police officers of the Village, who were first hired as full-time police officers prior to May 1, 2011, upon obtaining 20 years of creditable service with the Police Department and upon attaining the age of 50 years and who are retired from the Police Department, and who are without the benefit of any group health insurance coverage, whether private or public, shall be eligible upon retirement from the Village to apply for coverage under the village’s group health insurance plan. ('77 Code, § 36.020)
   (B)   All other full-time personnel of the Village, who were first hired as full-time employees prior to May 1, 2011, upon obtaining 20 years of creditable service with the village and upon attaining the age of 55 years and who are retired from the village and who are without the benefit of any group health insurance coverage, whether private or public, shall be eligible upon retirement from the Village to apply for coverage under the village’s group health plan.    (C)   In the event that any of the persons provided for in divisions (A) and (B) of this ordinance loses his or her life in the performance of duty, or receives in the performance of duty injuries from which he or she thereafter dies, and in the event such person leaves a widow or widower or a child or children under the age of 23 years and who is dependent on him or her and who is without the benefit of any group health insurance coverage, whether private or public, shall be eligible to apply for coverage under the Village’s group health plan. ('77 Code, § 36.022)
   (D)   Upon application by any of the persons provided for in divisions (A) through (C) above for participation in the village’s group health insurance plan or TRICARE, and upon the person paying to the village a sum equal to one-half of the cost for the group health insurance coverage, the Village shall then contribute the remaining portion of the cost for the coverage so that the person can be covered by the Village’s then existing group health insurance plan or TRICARE.    (E)   All other full-time employees of the Village shall upon retirement from the village, be eligible for such group health insurance coverage continuation as may be provided for by law at their own expense.
   (F)   The payment to be made by the Village pursuant to division (D) above shall cease whenever any retiree covered under the Village’s group health insurance plan:
      (1)   Has available any other group health insurance coverage, whether public or private; or
      (2)   Becomes eligible for Medicare or Medicaid. (77 Code, §§ 36.024, 36.026)
   (G)   In the event that Village payments cease pursuant to division (F) above, and upon application of the person for supplemental coverage under the Village’s group health insurance plan or TRICARE, and upon payment to the Village of one-half of the cost of the person’s portion of the coverage, the Village shall then contribute the remaining portion of the cost for the supplemental coverage.
   (H)   The provisions of this ordinance shall not vest in any public employee or official or retiree a property interest in the continuance of any group health insurance plan or program. (77 Code, § 36.027)
