§ 112.99 PENALTY.
   (A)   In addition to any other penalty provided in this section or by law, any person who violates any provision of any business license ordinance shall be subject to a civil penalty in an amount not to exceed $250 per violation, to be directly assessed by the City Recorder. The City Recorder, in a reasonable manner, may vary the amount of the penalty assessed to consider the appropriateness of the penalty to the size of the business of the violator; the gravity of the violation; the number of past and present violations committed; and the good faith of the violator in attempting to achieve compliance after notification of the violation. All civil penalties assessed that remain unpaid for 30 days after assessment will be docketed as a lien on real property in the lien book of the city and be enforced and collected in accordance with the procedure for foreclosing liens on real property.

   (B)   Unless otherwise indicated, any offense under this chapter is classified as a violation punishable by a fine set by resolution. Penalties not set by resolution shall be $250 per violation.
