149.04 ELIGIBLE LISTS.
   (a)   Eligible lists established under this chapter for promotional certification shall continue for a period of one year for police and fire fighters from the date of certification. Eligible lists established under this chapter for entrance level certification shall continue for a period of two years for police and fire fighters from the date of certification.
   (b)   Where an eligible list exists and a vacancy occurs which may be filled from such eligible list for either the police or fire service, the vacancy shall be filled within a period of not more than thirty days from the date of such vacancy. This number of personnel in the Police or Fire Departments
   (c)   No Current List. 
      (1)   The  Commission,  in  the  absence  of  a  current  eligible  list  forpromotional positions, shall not administer an examination for any position unless the City Administrator notifies the Commission that a vacancy will exist    which would require certification.
      (2)   The City Administrator shall notify the Commission within seven days after he/she becomes aware that a vacancy will exist in a position which would require certification for appointment or promotion.
      (3)   In the absence of a current eligible list and after being notified that a vacancy will exist, the Commission shall administer the proper examination no less than sixty nor more than ninety days after receiving notification of a vacancy. Within one hundred and twenty days of receiving the vacancy notification the Commission shall have completed testing, created an eligibility list, and certified the proper number of names from the list to the proper appointing authority.
   (d)   Entrance Level Eligibility Lists.
      (1)   Entrance level eligibility lists shall be maintained at all times. The Fire/Rescue Division and the Police Department utilizing the National Testing Network (NTN) can request an eligibility list from NTN at any time as they maintain a master list at all times from participants. When requested and received from the NTN the list shall rank the candidates in order with the highest scoring candidate being ranked number one.
         A.   Candidate lists obtained from NTN will be certified by the Civil Service Commission as the eligibility list to hire from for both the Fire/Rescue Division and Police Department. The eligibility list shall be certified until such time when the list needs to be updated in order to maintain a minimum number of applicants. 
   (e)   Names Not To be Certified For Appointment.  The name of any person appearing on an eligible list who:
      (1)   Fails to report or arrange within six days after receipt of notification, Saturdays, Sundays and holidays excluded, for an interview with an appointing authority;
      (2)   Fails to respond to a notice from the Civil Service Commission;
      (3)   Declines an appointment without reasons satisfactory to the Civil  Service Commission; or
      (4)   Cannot be located by the postal authorities; shall not thereafter be certified to any appointing authority as eligible for appointment, unless a    thoroughly satisfactory explanation of the circumstances is  made to the Commission. The eligible person shall be notified to this effect unless his whereabouts are unknown. 
   (f)   Disqualification of Eligibles.  If at any time after the creating of an eligible list, the Commission has reason to believe that any person whose name appears on any list is disqualified for appointment because of any violations of the background removal standards adopted by the Commission, such person shall be notified and given an opportunity to be heard.  If such person shall fail to appear for hearing, or upon being heard, fail to satisfy the Commission, his name shall be removed from such eligible list.     
   (g)   Change of Address.  Each person on an eligible list shall file with the Commission written notice of any change of address, and failure to do so may be considered sufficient reason for not certifying his name to appointing authorities for future appointments.
   (h)   Tie Grade. In the event two or more applicants receive the same grade, priority shall be first given and granted to any provisional appointee, then applicants who are veterans shall receive priority in rank on the eligible list over non-veterans on the list with a grade equal to the veteran. All other ties in rank shall be decided at the discretion of the appointing authority.
