(A) There is hereby created a Zoning Board of Appeals consisting of five voting members. The members of the Board shall be electors of the City appointed by the Mayor, subject to the approval of the Council by a majority vote of its members. All members of the Board shall be appointed to four-year terms of office.
If a person appointed as a member of the Board vacates that position, the Mayor shall appoint a successor, subject to the approval of the Council by a majority vote of its members. A successor appointed to fill a vacancy on the Board shall be an elector of the City and shall serve for the remainder of the unexpired term of the predecessor.

(B) The Zoning Board of Appeals shall have those powers, duties and functions as provided by this Charter and as provided by the ordinances and resolutions of the City. All decisions of the Board shall be final and shall not be subject to appeal to the Council or any other agency of the City. Appeals may be made to the courts as provided by the laws of Ohio by any interested party, including the City.
