909.07  CONSTRUCTION SITE RUNOFF CONTROL PERMITS.
   (a)   A City of Tiffin Construction Site Runoff Control Permit is required for construction activities that result in land disturbance of one (1) or more acres of land, or less than one (1) acre of land as part of a larger development that will ultimately disturb one (1) or more acres of land.
   (b)   No earth-disturbing activities requiring a permit shall commence prior to the issuance of a City of Tiffin Construction Site Runoff Control Permit by the City Engineer.
   (c)   Construction Site Runoff Control Permit Application.
      (1)   The Construction Site Runoff Control Permit Application shall be made by the owner of the property involved, or an authorized agent employed in connection with the proposed work.
      (2)   The application shall be prepared in writing on printed forms prescribed by the City Engineer, and shall contain the full names and addresses of the owner, construction site operator, and certified storm water inspector; the project location; a brief description of the proposed work; the estimated project schedule; a statement on behalf of the owner that the proposed work will be in accordance with these Storm Water Management Regulations and all laws and ordinances applying to the premises; and such other information as may be required by the City Engineer. 
      (3)   The applicant shall submit the following documents to the City Engineer for Permit Application Review - detailed requirements for Construction Site Runoff Control Permit Application Review and Approval are found in the City of Tiffin Storm Water Management Program:
         A.   One (1) copy of completed Construction Site Runoff Control Permit Application Form
         B.   Two (2) copies of a complete Storm Water Pollution Prevention Plan (SWPPP). Refer to Section 909.08 for additional requirements.
         C.   Two (2) sets of project design plans
         D.   Application fees and performance bond
            1.   Administration Fee: $250.00: This fee covers costs incurred by the City for administration and periodic inspections of the construction site over the duration of the project. This fee is due at the time of application submittal.
            2.   Application Review Fee: $300.00 for up to 2 hours of review by City Engineer, an additional $150.00 for each additional hour: This fee covers costs incurred by the City for the review of the application submittal. The initial $300.00 is due at the time of application submittal and any additional time incurred for application review is due before the Permit is issued.
            3.   Performance Bond: $1,000.00 or actual cost of construction of all Storm Water BMPs, whichever is greater: This bond will be due upon approval. It covers possible costs in the event the City is required to perform any work to bring the construction site into compliance with the approved plans and all applicable storm water laws and regulations.
         E.   Any pertinent information related to the Storm Water BMP design including plan sheets, forms, and storm drainage calculations. Verify that all  SWPPP  criteria  are met  prior  to  submittal  by  reviewing the Ohio  EPA SWPPP Checklist  for Construction Activities  (a copy of  the  checklist  is  included  in  the  City  of  Tiffin  Storm  Water Management Program and available online at: https://www.epa.ohio.gov/portals/35/storm/CGPSWP3Checklist.pdf).                                          
      (4)   Plans submitted to  the City Engineer for review and approval, shall  be accompanied by  all  other required permits and  documentation relevant to the project, including  but  not  limited to the  permits  required and  issued  by the U.S. Army Corps of Engineers, the Ohio EPA and ODNR Division of Water.
   (d)   Construction Site Runoff Control Permit Application Review and Approval. 
      (1)     The City Engineer shall review the Application submittal within thirty (30) calendar days of receipt and indicate approval or disapproval.  Indication of disapproval shall include deficiencies and the procedure for resubmittal.
   (e)   Construction Site Runoff Control Permit Renewal & Expiration.
      (1)   Permits issued in accordance with this regulation shall remain valid for two (2) years from date of approval. Re-application or renewal may be required for projects exceeding this period as well as bond renewal.
      (2)   If earth disturbing activity is not initiated within two (2) years of the date that the Construction Site Runoff Control Permit is issued, such permit shall be considered void by the City. The site owner may request an extension of the Construction Site Runoff Control Permit in writing to the City Engineer prior to the expiration date. The City Engineer may extend the time allowed for the Construction Site Runoff Control Permit upon review of the written request.
   (f)   Other Permits Required.
      (1)    Plans developed by the site owners and approved by the City in accordance with this regulation do not relieve the site owner of responsibility for obtaining and complying with all other necessary permits and/or approvals from federal, state, county, and local agencies and departments.
      (2)    If requirements vary, the most stringent requirement shall be followed.
   (g)    Inspection Requirements.
      (1)    The City shall conduct inspections for all active construction sites within the City's MS4 in order to assess compliance with the approved SWPPP and determine whether the storm water controls required by the approved SWPPP are effective and installed properly until the project site reaches final stabilization as determined by the City Engineer.
   (h)   Construction Site Runoff Control Permit Closeout.
      (1)    The project closeout process is used to end Construction Site Runoff Control Permit coverage once all land disturbance activities have been completed. The Permit shall be in effect until the following requirements have been met:
         A.   The Site has been stabilized
         B.   A set of as-built drawings of stormwater BMPs certified by a  Professional Engineer is submitted to the City
         C.   A notice of termination (NOT) from Ohio EPA has been  submitted to the City
         D.   A City of Tiffin Notice of Termination Form has been submitted to the City Engineer
         E.   A final site inspection has been completed by the City 
         F.   A Storm Water BMP I&M agreement is approved by the City
