1309.04  REQUEST FOR VOLUNTARY INSPECTION.
   Upon determining that probable cause exists to believe that any occupied or vacant structure or premises is unsafe or insecure and thereby dangerous to the residents of the Municipality, the Code Official may request the occupant, or lessee or owner if the building or structure is unoccupied, to permit a voluntary inspection of the premises. The occupant, lessee, or owner shall be advised by the Code Official that consent to such an inspection is voluntary. Should consent be denied and the Code Official has determined that probable cause exists to believe that the structure, premises or equipment is unsafe or unfit for human occupancy or  dangerous to the public, the Code Official may request a court of proper jurisdiction to issue a search warrant authorizing an inspection of the premises under the rules applicable to search warrants.
