907.99 PENALTY.
   Any discharger who violates an order of the City or who has failed to comply with any provision of this chapter or the regulations or rules of the City shall be found in noncompliance of the Pretreatment Ordinance by the City. The penalty will be by a fine of a minimum of one thousand dollars ($1,000) per day up to a maximum as prescribed within the City NPDES permit, in the event the City is in violation of the permit, due to the discharger's noncompliance. The fine will include all costs borne by the City including but not limited to labor, sampling, lab testing, chemicals, consulting and legal fees, etc. Each day on which a violation occurs or continues shall be deemed a separate and distinct offense. In addition to the penalties herein, the City may recover reasonable attorney's fees, court costs, court reporters' fees and other expenses of litigation by appropriate suit at law against the person found to have violated any provision of this chapter or the orders, rules, regulations and permits issued hereunder.
