§ 31.53 TOWN BOARD OF ZONING APPEALS.
   There is hereby established a Thorntown Advisory Board of Zoning Appeals pursuant to I.C. 36-7-4-901. This Board shall be known as Thorntown Advisory Board of Zoning Appeals.
   (A)   Membership. The Thorntown Advisory Board of Zoning Appeals shall consist of five members as follows:
      (1)   The Town Council President shall appoint three citizen members, of whom one must be a member of the Plan Commission and two must not be members of the Plan Commission.
      (2)   The Town Council shall appoint one citizen member who must not be a member of the Plan
Commission.
      (3)   The Plan Commission shall appoint one member from the Plan Commission's membership who must be a county agricultural agent or a citizen member of the Plan Commission other than the member appointed under subdivision (1).
      (4)   None of the members of the Town Advisory Board of Zoning Appeals may hold an elected office or any other appointed office in municipal, county or state government, except as provided herein, and authorized by I.C. 36-7-4-902.
      (5)   A member of the Town Advisory Board of Zoning Appeals must meet one of the following requirements:
         (a)   The member must be a resident of the jurisdictional area of the Board;
         (b)   The member must be a resident of the county and also an owner of real property located in whole or in part in the town. However, at least a majority of the total number of citizen members appointed to the Thorntown Advisory Board of Zoning Appeals must be residents of the town. The Board shall determine whether a member meets all applicable residency requirements for appointment in accordance with Uniform Rules prescribed by the Board.
   (B)   Term of appointment. Upon the establishment of the Town Advisory Board of Zoning Appeals, the members shall initially be appointed for the following terms of office:
      (1)   One for a term of one year;
      (2)   One for a term of two years;
      (3)   One for a term of three years; and
      (4)   Two for a term of four years.
   When an initial term of office expires, each new appointment is for a term of four years. Each term expires on the first Monday of January of the first, second, third or fourth year respectively after the year of the member's appointment.
   (C)   Duties and powers, organization and procedures. The duties and powers, organization, procedure and other applicable laws governing the Town Advisory Board of Zoning Appeals are adopted as illustrated in I.C. 36-7-4-900, et seq.
