§ 32.21 COMPENSATORY TIME OFF POLICY.
   (A)   The Town of Thorntown, Indiana, may, at the discretion of the Town Council and/or department heads, elect to utilize compensatory time off "comp time" in lieu of monetary compensation for overtime hours worked by eligible town employees. When compensatory time off is substituted for overtime pay, the employee shall be compensated at the rate of one and one-half hours of comp time off for every hour worked over 40 hours in a work week or work period.
   (B)   An eligible employee may accrue a balance of 80 hours of comp time. When the eligible employee has accrued 80 hours of compensatory time off, he or she shall be paid overtime for any hours worked in excess of 40 hours in a work week until such accrued balance is reduced to below 80 hours. However, if there are instances where it would be appropriate for an employee to accrue more than 80 hours of comp time, the department head may approve this additional accrual of comp time at his or her discretion.
   (C)   Employees must submit requests to use earned comp time to their department head. Department heads shall allow eligible employees to use accrued comp time within a reasonable period of time after the employee has made such a request, subject to the department head's discretion after considering the needs of the department and in a manner that will not unduly disrupt the operations of the department.
   (D)   Eligible employees must use comp time within 90 days of the date that the comp time was earned, unless they have sought and received permission from the Town Council to extend the time within which they need to use their comp time. If the employee fails to use their comp time within 90 days of the date that the comp time was earned and has either failed to seek an extension from the Town Council, or was denied an extension within which to use their comp time, the Town Council shall have the discretion to either extend the time within which the employee may use their comp time or pay out any comp time which has been earned at least 90 days prior at a rate of one and one-half (1 ½) times the employee's hourly rate at the time the comp time was earned.
   (E)   Accrued comp time hours may be carried forward from calendar year to calendar year upon approval by the Town Council.
   (F)   Each eligible employee who will be given comp time in lieu of overtime pay shall execute a separate comprehensive time off agreement, which is attached to Ordinance 2021-7 and is incorporated herein by reference.
   (G)   Upon separation of employment, the town shall pay out to the employee his or her accrued but unused comp time balance.
