(A) All acts as defined by I.C. 13-17-9-1, subject to the conditions of I.C. 13-17-9-3, and as amended, including exemptions as defined herein;
(B) Burning of clean wood; and/or
(C) Recreational or ceremonial fires that meet the following conditions.
(1) Only clean untreated wood or charcoal shall be used. Paper products can be used for ignition purposes only.
(2) The fire shall not be ignited more than two hours before the recreational activity is to take place and shall be extinguished upon the conclusion of the activity.
(3) The pile to be burned shall be less than 125 cubic feet. (For example: five feet long, five feet wide, and five feet high.)
(4) The fires shall not be used solely for disposal purposes.
(5) Fires shall not take place within 50 feet of any fuel storage area or pipeline.
(6) Burning of predominantly wood structures on real property of wood remnants of the demolition of a predominantly wooden structure originally located on real properly.
(7) The Town Police and Sugar Creek Fire Department must be notified 72 hours (three days) before the planned burn.
(8) All allowed acts and variances are subject to and shall adhere to this subchapter policies and guidelines as adopted by the town.
