For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ABANDONED VEHICLE.
(1) Any vehicle left unattended on private property for 72 hours without consent of the owner or lessee of such property or his or her legally authorized agent;
(2) Any vehicle left unattended on private property without the consent of the owner or lessee of the property or his or her legally authorized agent when such private property has been posted to give notice that any vehicles left on the private property without permission may be towed at the owner’s expense. Such notice shall be posted with signs visible to ordinarily observant persons on the property; or
(3) Any vehicle left unattended on public property, including any portion of a highway, street, alley or other right-of-way for 24 hours or longer unless the owner or driver has conspicuously affixed a dated notice stating his or her intention to return or has otherwise notified the Police Department of his or her intention to remove it within 72 hours.
INOPERABLE MOTOR VEHICLE. Any motor vehicle missing wheels, tires, windshield, motor, or transmission, or which has been so damaged as to appear not safely operable. Any vehicle that remains parked or near the same location for more than 30 consecutive days shall be presumed to be inoperable.
JUNK VEHICLE.
(1) Any vehicle that is partially dismantled, wrecked, or extensively damaged or deteriorated, including, but not limited to, vehicles with deflated, wrecked, or missing tires or rims; missing or wrecked body parts; broken or missing headlights, taillights, or brake lights; broken, cracked, or missing windows or windshields; or missing all or part of the motor or transmission; and is not capable of lawful operation on public roads at the time of any notice or citation issued by a town police officer.
(2) JUNK VEHICLES shall include, but not limited to:
(a) Automobiles;
(b) All-terrain vehicles;
(c) Motorcycles;
(d) Trailers;
(e) Semi-trailers;
(f) Semis;
(g) Trucks; and
(h) Wagons.
(3) This definition does not include vehicles in the process of routine maintenance or repair, such as oil changes, cleaning, changing a flat tire, minor rust repairs, and similar activities.
ORDINARY PUBLIC VIEW. Readily visible by a person on a public street, sidewalk, or adjacent lot to the premises.
USE OF VEHICLES FOR STORAGE. No junk vehicles or vehicles as defined in this subchapter shall be used for the use of storage of any kind for more than five days.
VEHICLE. A machine propelled by power, other than human power, and includes campers, trailers, and other equipment designed to be carried upon or towed behind such powered vehicle; designed to travel along the ground by use of wheels, treads, runners, or slides, or upon such vehicle, and transport persons or property or pull machinery, and shall include, without limitation, automobile, airplane, truck, trailer, camper, motorcycle, motor scooter, recreational vehicle, tractor, wagon, semi, and semi-trailers.
