§ 10.23 PENALTY NOT LESS THAN STATUTORY PENALTY.
   Notwithstanding the provisions of any section of this code setting forth a penalty, the maximum penalty which may be imposed for any violation shall not be less than the penalty prescribed by statutes for the same offense.
