Whenever any person by the use of signs, circulars, telephone books or newspapers advertises, holds out or represents that such person is in business in the Town, or whenever any person holds an active license of permit issued by a governmental agency indicating that such person is in business in the Town, and such person fails to deny by a sworn statement given to the Town Clerk that such person is not conducting a business in the Town, after being requested to so swear by the Town Clerk, then these facts shall be considered prima facie evidence if such person is conducting a business in the Town.
