3-6-6: OTHER CONDITIONS:
The following additional conditions are hereby imposed:
   A.   The construction, maintenance, use and removal of all structures, lines and equipment of the franchisee shall comply with the codes of the town, and laws of the state, and shall be done so as to cause minimum interference with abutting private property or public use of any streets, alleys, avenues, parkways, lanes, bridges, or other public ways and places.
   B.   The franchisee shall, in the event of removal, repair or resiting of any of its facilities at its own expense, restore any town property, streets or ways, disturbed to its original contour and condition. If at any time during the period of the franchise, the town shall alter or change any street, alley, or public ways, the franchisee, upon reasonable notice by the town, shall at its own expense, resite any of its facilities.
   C.   The franchisee shall, on the request of any person holding a building moving permit or a permit for an oversized transport issued by the town, temporarily raise or lower its wires to permit the moving of buildings, provided:
      1.   The expense of such temporary raising or lowering of wires is paid by the person, including, if required by the franchisee, making such payment in advance; and
      2.   The franchisee is given not less than three (3) business days' advance notice to arrange for such temporary wire changes.
   D.   The franchisee, after obtaining a permit from the town, shall have the authority to trim trees overhanging any streets in the franchise area so as to prevent branches from coming in contact with the franchisee's wires and cables, except that, at the option of the town, such trimming may be done by it or under its supervision and direction at the franchisee's expense.
