7-4-3: PRIVATE WASTEWATER DISPOSAL:
   A.   Connection To Private System: Where a public sanitary or combined sewer is not available under the provisions of subsection 7-4-2D of this chapter, the building sewer shall be connected to a private wastewater disposal system complying with the provisions of this section.
   B.   Permit Required; Application; Fee:
      1.   Before commencement of construction of a private wastewater disposal system, the owner shall first obtain a written permit approved by the town council.
      2.   The application for such a permit shall be made on a form furnished by the town, which the applicant shall supplement by any plans, specifications, and other information as are deemed necessary by the town.
      3.   A permit and inspection fee of five hundred dollars ($500.00) shall be paid to the town at the time the application is filed.
   C.   Inspection Required:
      1.   A permit for a private wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the superintendent. The superintendent shall be allowed to inspect the work at any stage of construction, and, in any event, the applicant for the permit shall notify the superintendent when the work is ready for final inspection, and before any underground portions are covered.
      2.   The inspection shall be made within seventy two (72) hours of the receipt of the notice by the town.
   D.   Compliance With State Requirements: The type, capacities, location, and layout of a private wastewater disposal system shall comply with all recommendations of the department of public health of the state of Montana.
   E.   Septic Tank Use Limitation: Any septic tanks, cesspools, and other private wastewater disposal facilities which are being used on the effective date hereof may not be replaced, if sewer service is available.
   F.   Maintenance In Sanitary Manner: The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times, at no expense to the town.
   G.   Additional Requirements: No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by the health officer. (Ord., 6-9-1998)
