§ 150.26 MORATORIUM ON PERMITS, IF OUTSTANDING ORDERS OR FEES ARE NOT IN COMPLIANCE.
   (A)   Purpose. Compliance with building, zoning and property maintenance code is essential to protect the quiet enjoyment of property as well as expectations and property values of residents of the village. Any person, contractor or builder who has failed to resolve an outstanding order by the Village Building Official should not be allowed the opportunity to continue to construct, erect or otherwise proceed or commence any project if other matters have not been resolved or fees have not been paid. A portion of all building code permit fees must be remitted to the state; therefore it is the further purpose of this section to prevent the compounding of failure to pay fees due and owing the village and state.
   (B)   Moratorium. No building permit or certificate of occupancy shall be issued to any person for any work or the use of any building or structure within the village if any outstanding order by the Building Official has not been corrected or resolved. Nor shall any building permit or certificate of occupancy be issued to a related party which does not or has not paid in full any and all fees due the village for any application or permit. A related party means, for the purpose of this action, any owner or occupant of real estate and/or any builder or contractor who has permitted or caused the circumstance to exist that has resulted in the issuance of the order by the Building Official or who has failed to fully pay for any and all fees due and payable for any building or zoning permit, certificate of occupancy or other fees for construction within the village. After an order is resolved and/or any fees paid, the Building Official may process other applications for permits submitted by a related party.
   (C)   Enforcement. In addition to the moratorium provided for herein, all other penalties and remedies provided for in this code of ordinances or by state law shall remain in full force and effect. Imposition of this moratorium shall not waive the right to enforce or obtain criminal penalties or civil enforcement otherwise authorized or permitted by laws or ordinances.
