§ 150.22 CLASS B CONSTRUCTION.
   (A)   Permit. The Hamilton County Building Inspector is hereby authorized to issue the appropriate building permit in all cases of Class B construction.
   (B)   Application for permits. Applicants for permits for Class B construction shall file with the Municipal Building Inspector a sworn application, in writing, in triplicate, on the appropriate application form to be furnished by the Building Inspector and the application shall include, but not by way of limitation, the following information:
      (1)   Name, address and description of the applicant and owner.
      (2)   Legal description of the parcel of real estate for which the permit is sought.
      (3)   Plans and specifications for the Class B construction for which the permit is sought.
      (4)   Location of driveway entrances and exits to the premises in question.
      (5)   Location of gas, electric and water utilities to serve the parcel in question.
      (6)   Location of fire hydrant serving parcel in question.
      (7)   A contour plat and established grade of the premises, together with the proposed location of the construction and/or improvement to be placed thereon.
      (8)   Plans, specifications and drawings for the building sought to be constructed or improved and for which the permit is sought, together with such other sketches, plats, data and information which the Hamilton County Building Inspector shall require to be filed in accordance with the Hamilton County Building Code.
      (9)   Upon submission of the plans, drawings and specifications (in triplicate) to the Municipal Building Inspector, the same shall be submitted to the Engineer, the Fire Chief and the Planning Commission, each of whom shall review the same for compliance with Planning and Zoning Code, location of driveways, exits and entrances to the proposed construction, location of gas, electric and other utilities and location and adequacy of water mains and fire hydrants for compliance with the state fire regulations and code. The safety and stability of the soil structure shall be reviewed with regard to adjoining parcels and such other relevant engineering requirements as are necessary to insure safe construction, such review to be made by the Municipal Engineer. Approval by the Planning Commission, the Municipal Engineer and the Fire Chief shall be required prior to submission of the same to the Hamilton County Building Inspector for issuance of a building permit authorizing the structure. The permit application required by this section shall be processed by the Building Inspector, Municipal Engineer, Fire Chief, and Planning Commission within 45 calendar days after application.
      (10)   All applications for Class B construction shall be accompanied by a plot plan indicating a field survey by a registered surveyor of the site upon which the structure is to be placed and the improvement made. Such survey shall show, in addition to the actual shape and dimensions of the parcel of land on which the structure is to be built, the exact size and location of all existing buildings, proposed buildings (including protrusions such as porches, chimneys, bay windows, carports and similar protrusions), and the improvements and additions shall show the dimensions and distances to all lot lines and the intended use of each structure and such other pertinent information as is necessary to determine compliance with the Planning and Zoning Code and safety regulations. Survey points shall be maintained and be accessible at all times during the construction period and in addition, the plot plans shall include and indicate location of all driveways, parking areas, gas, water and electric utilities, septic tanks and sewage systems required to serve the improvements and the location of the nearest fire hydrant.
      (11)   Each applicant for a building permit under this section shall complete the required building permit application and file three copies with the requisite plot plan required under division (B)(10) of this section together with a general description of the use of the proposed improvement.
   (C)   Access.
      (1)   No building permit shall be issued by the Hamilton County Building Inspector to permit the construction, addition or improvement of any Class B construction in the village on any lot or parcel of land unless such lot or parcel of land is located on and fronts on a dedicated street and unless all improvements in such street have been completed or the applicant has provided a sufficient indemnity and security to the municipality in the form of a certified check or bond in an amount equal to the estimated cost of such improvement of the access street equivalent to other public streets within the municipality.
      (2)   The improvement of the access street shall include water mains in the street, fire plugs installed to a size in accordance with the requirements of the Indian Hill Water Department and the Ohio Fire Code and relevant regulations. Such water mains shall be located in the street on which the lot or parcel of land fronts or abuts. In addition thereto, the improvement of the access street shall include the installation of pedestrian walks along the front of the property to be improved if there are no pedestrian walks along either side of the access street on which the parcel of land fronts or abuts. However, the Village Council by a three-fourths vote of the members shall have the right to waive the requirement of sidewalks upon written application of the owner and/or developer of such lot or parcel of land.
   (D)   Investigation; refusal or issuance of permit.
      (1)   Upon receipt of the application for a Class B construction permit, the original shall be referred to the Municipal Building Inspector, who shall make an investigation of the plans and specifications, on-site inspection, and review the plans and specifications for conformity to the Building Code
      (2)   If, as a result of the review of the application by the Building Inspector, the plans and specifications and on-site inspection show the proposed construction to be in compliance with the Building Code, the application shall be submitted to the Municipal Engineer for approval of driveway locations, exits and entrances to the premises, location of gas, electric and water utilities to serve the proposed construction, location of fire hydrants to insure fire protection as outlined in the state fire regulations and consideration of the proposed plat contour in relation to site construction, safety and effect of soil stability to adjoining parcels. The Engineer shall make his or her report of approval or rejection of the application to the Building Inspector with the reasons for the rejection, if any, in writing.
      (3)   Thereafter, and simultaneously, the Municipal Building Inspector shall submit the application and relevant documents to the Planning Commission for their approval, where required. If the application is rejected by the Planning Commission, such Planning Commission shall state, in writing, the reasons for such rejection.
   (E)   Submission to County Building Inspector. Upon the approval of the Municipal Building Inspector, the Municipal Engineer and the Planning Commission, the application and relevant documents shall thereupon be returned to the applicant for his or her submission of the same to the Hamilton County Building Inspector. The Municipal Building Inspector's approval of an application shall not be valid unless it includes the review and approval of the Municipal Engineer. If the building permit is denied, the Municipal Building Inspector shall set forth in writing the reasons for the denial of the issuance thereof, and a copy of such reasons shall be given to the applicant.
