§ 132.15 COMMERCIAL TRUCK REGULATION.
   (A)   Purpose. The purpose of this section is to protect the public health, safety, morals, general welfare, security, prosperity, and contentment of all inhabitants of the village by suppressing the creation or maintenance of excessive noise during the late hours of the evening or early morning while at the same time accommodating the service and business needs of the community.
   (B)   Regulation.
      (1)   It shall be unlawful for any person, between the hours 10:00 p.m. and 6:30 a.m. the following day, on streets within a residential area, to operate a truck or any hydraulic, mechanical or electrical equipment, that is designed, or intended to be used, for one or more of the following purposes:
         (a)   The collection, removal, or disposal of waste, garbage or recyclable materials;
         (b)   For the delivery, loading, unloading, opening, closing or other handling of boxes, crates, containers, cans, building materials or similar objects; or
         (c)   For the construction or demolition of buildings or structures or for excavation.
      (2)   This regulation is not intended, nor shall it be construed to apply to, taxies, emergency vehicles, snow removal vehicles or trucks passing through the village on Wooster Pike, nor shall it be construed to alter the limitation on hours permitted for construction activity set for in §§ 93.45 through 93.49 of this code of ordinances.
   (C)   Penalty. Whoever violates division (B) of this section shall be guilty of a minor misdemeanor. Each day on which a violation occurs shall constitute a separate offense.
