§ 94.47 GRANTING OF REVOCABLE STREET PRIVILEGE.
   (A)   Any applicant for a revocable street privilege, shall submit the application for the permit to the Village Street Commissioner. Eight copies shall be provided of all information pertaining to the application.
   (B)   The following information shall be included in and made part of the application:
      (1)   A detailed plan which shall show the construction proposed, the property lines of the right-of-way, the applicants property and the property lines of the adjoining property owners.
      (2)   A schematic drawing or plan to scale describing and depicting existing improvements in the area and other significant landmarks. All sidewalks, driveways, road surfaces, existing drainage and significant shrubbery, trees or other items in the immediate vicinity shall be depicted.
      (3)   A narrative explanation of the purpose of the revocable street privilege. It shall include the benefits which would accrue to the applicant, and any hardships or practical difficulties that would be alleviated if the permit were to be granted.
      (4)   A specific plan for the restoration of any improvements in the public right-of-way affected by the applicants proposed structure.
      (5)   An acknowledgment that if this permit were to be granted, that the applicant understands that the revocation of such a permit is completely within the discretion of the village and that the granting of the permit shall not vest the applicant with any additional rights other than a 30-day notice in advance of the effective date of revocation. The applicant shall also acknowledge that he or she is bound by the additional obligations and provisions of this subchapter
      (6)   Any additional information requested by the Village Street Commissioner in order for him or her to form a recommendation to the Village Council
      (7)   A $100 fee for the administration and review of the application, which fee is non- refundable.
   (C)   The Village Street Commissioner shall review the information provided in the application documents and shall consult the village zoning and building official and with such other persons he or she deems necessary. The Village Street Commissioner may suggest changes or request such additional information as he or she deems appropriate. Once the review and any revisions to the application are completed, the Village Street Commissioner shall forward the copies of the application to Village Council with his or her recommendation and comments.
   (D)   Council shall act on the application and consider it as an ordinance.
   (E)   Council may suggest revisions in the application prior to its vote. If Council grants the application, it shall incorporate the appropriate documents of the application and may impose such additional conditions on such approval as it deems appropriate. If approved, the Clerk of Council shall return to the Village Street Commissioner the final ordinance and attachments thereto, which shall constitute the permit. The Village Street Commissioner shall notify the applicant of Village Council's decision.
   (F)   The Village Street Commissioner is authorized to immediately order any work done by applicant in the public right-of-way to be immediately stopped if such work is not in conformity with the terms and conditions of the permit.
