§ 94.40 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BUILDING ENCROACHMENT. The occupancy of a public street, alley or way on, under, or above the street surface by a construction constituting a part of a building or any other improvement or structure.
   PERMITTEE. A person, firm or corporation in possession of a revocable street privilege. Where the privilege granted is directly appurtenant to the abutting real estate, PERMITTEE shall mean the owner of such real estate.
   PRIVILEGED PREMISES. The lot or parcel of real estate to which a revocable street privilege is appurtenant.
   REVOCABLE STREET PRIVILEGE. Any authorized or permitted private right for the use of a designated part of a village street, alley or way, separate and distinct from the use of village streets, alleys and ways by the general public or by authorized public utility corporations or pursuant to any franchise agreements authorized by this village. Such privilege may only be granted by an ordinance adopted by the Village Council pursuant to this subchapter.
