§ 94.18 REGULATIONS.
   (A)   Unless otherwise provided for in this subchapter, the substantive provisions of the Hamilton County Driveway Regulations, effective July 1, 1989, regarding the standards of material and construction to be observed in the installation of driveways, are hereby adopted and incorporated by reference as the driveway regulations for the municipality and shall regulate the placement, standards of construction and materials for all types of driveways for which specific provision is made therein.
   (B)   For the purpose of this subchapter, the phrase “building inspector” as it appears in the Hamilton County Driveway Regulations shall be understood to mean the Village Building Official.
   (C)   A permit may either be issued pursuant to the application, issued with conditions imposed pursuant to § 94.17, or referred to the Planning Commission for review and consideration. Upon such referral, the Planning Commission may approve the application as submitted, approve with conditions or deny the application, if alternative access is available.
   (D)   No permit shall be issued by the Village Building Official until he or she has approved the method of disposing of surface drainage along the street right-of-way by means of an approved culvert, or other suitable means of drainage, under the proposed driveway with the proper covering over the culvert, or other suitable means of drainage. Any approved drainage system shall be maintained in good order by the property owner which is provided access by a driveway. This includes keeping conduit and other devices which are intended to serve as part of the drainage system free and clear of debris, dirt, vegetation or other items or accumulation that inhibit free flow of water.
   (E)   No single driveway shall be permitted to serve more than four lots or dwellings. In addition, no driveway shall be permitted which is designed or constructed in such a manner as to serve more than one dwelling or lot unless the following minimum requirements and specifications are met:
      (1)   Each lot intended to be served by such driveway shall be within 500 feet of a fire hydrant approved by the Indian Hill Waterworks and the supply line to the fire hydrant shall be a minimum of six inches in diameter if such service line is looped; if such service line to the fire hydrant is a dead end, then such service line shall be a minimum eight inches in diameter, to be installed and maintained by the owner of the lots serviced by such fire hydrants at the expense of the lot owners.
      (2)   A 25-foot wide right-of-way shall be provided for such driveways. The width of such driveway shall be a minimum of 16 feet in width, and constructed with a minimum of five inch crushed stone roadway base, topped with either asphalt or concrete, installed at the cost of the owners thereof and a written, recordable agreement by the owners of the lots providing for the continued maintenance of the private driveway to meet these minimum specifications so long as such driveway remains. Alternative construction of such driveway may be approved by the Building Official if it improves the aesthetic appearance or drainage and does not significantly increase maintenance requirements.
      (3)   The minimum square foot requirement of the residential district within which the property is located shall be in addition to the 25-foot wide private drive right-of-way.
      (4)   House numbers shall be displayed for each home served by such drive. They shall be displayed at the intersection of the private drive with the public street and displayed in a manner that the house numbers are clearly and readily visible from the public right-of-way. Such house numbers must also be displayed in a similar manner on the house itself.
   (F)   No permit shall be issued for a driveway which intersects with a street right-of-way until the Village Building Official has approved the location of the intersection. The Village Building Official shall consider the effect of the driveway location as the same affects the safety of motorists and pedestrians and shall withhold approval when he or she deems that an alternate intersection of the street and driveway would protect persons or property and that such alternate location of the intersection is reasonably available to the applicant.
      (1)   Unless modified by the Building Official, the width of a driveway and driveway apron shall be as follows:

      (2)   However, such widths may be increased by the Village Building Official if he or she determines that, due to conditions such as the road, traffic conditions, use of driveway, or other factors that impact on the ability to enter or exit the driveway safely, a wider driveway or driveway apron is appropriate.
