(A) Permit.
(1) No person, firm or corporation shall clean, clean out or remove sludge, waste or other matter from any septic tank or cesspool within the municipality without first having made application for a permit to do so, and having been granted such permit at the office of the Chief of Police.
(2) The application and permit shall be in such form as determined by the municipality to be proper, but in any event, such permit shall provide that the sludge, waste and other matter removed from any such septic tank or cesspool shall not be disposed of, deposited or distributed within the municipality.

(B) License.
(1) No person, firm or corporation shall engage in the business of cleaning out or removing sludge, waste or other matter from septic tanks or cesspools in the municipality unless and until a license has been secured as hereinafter set forth.
(2) The Chief of Police shall issue a license to engage in the business of cleaning out or removing sludge, waste or other matter from septic tanks or cesspools to any person, firm or corporation upon the payment of $5 by the applicant, and upon being satisfied that:
(a) The applicant is a person, firm or corporation fitted to perform adequately such services;
(b) The financial responsibility of such person, firm or corporation is such that it can respond financially for any legal liability which may be incurred by it in the performance of such services; and
(c) The equipment of such person, firm or corporation is fully adequate to perform the services in an adequate and sanitary manner.
(3) The license shall be for a period of one year. However, if at any time the Chief of Police finds that a person, firm or corporation to whom such license has been issued fails to meet the qualifications set forth herein, the Chief of Police may revoke such license. In such event, the licensee may file an appeal to the ruling of the Chief of Police with Council, and its decision with respect to the approval or rejection of the ruling of the Chief of Police shall be final.
