A. It shall be unlawful for any person to burn papers, rubbish, garbage, refuse, leaves, grass, brush, animal waste, treated or painted wood, or combustible substances within the city.
B. Bonfires, open fires, or camp fires may be ignited or burned in connection with recreational, religious, or school activities after first acquiring a burn permit from the Town. Said fires may only be ignited with and burn untreated or unpainted wood.
C. One recreational fire per lot which meets the following definition shall be exempt from a burn permit:
1. An outdoor, on privately owned property, in an appropriate non- combustible container or fire ring, burning materials other than rubbish, with a total fire area of three feet (3') or less inside diameter and two feet (2') or less in height, for pleasure, religious, ceremonial, cooking, warmth or other similar purposes.
2. Recreational fires shall not be conducted within fifteen feet (15') of a structure or combustible material. Conditions which could cause a fire to spread within fifteen feet (15') of a structure shall be removed or eliminated prior to ignition.
3. Recreational fires must utilize a screen or spark arrestor and it must be in place while burning.
D. Open burning shall be constantly attended by an adult until the fire is extinguished. A minimum of one (1) portable fire extinguisher with a minimum 4-A rating or other approved on-site fire extinguishing equipment must be available for immediate utilization.
E. Open burning shall not be permitted between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M.
F. Outdoor grills, barbeques, charcoal grills, purchased gas outdoor fireplaces are exempt when used in accordance with the manufacturer's instructions.
G. Open burning shall be prohibited when weather conditions or local circumstances make such fires hazardous. (Ord. 225, 7-22-2021)
