3-2-3: FAILURE TO COMPLY; NOTICE; ABATEMENT:
   A.   Notice; Time Limit: It shall be unlawful for any person to fail, neglect or refuse to remove any offending weed or accumulation of garbage within three (3) days or within an otherwise designated time period after the date written notice of the nuisance is received by such person from a town official. Every day the nuisance continues, commencing on the date on which it is ordered to be removed in the notice, shall constitute a separate offense. Notification will be considered when hand delivered or after having been mailed by certified mail to the last known address of the premises, or when posted in a prominent place on the subject property if the person in charge cannot, with due diligence and within a reasonable time, be located. The notice shall state generally the nature and location of the nuisance and the duty and time within which said nuisance must be abated. (Ord. 160, 1-4-2005; amd. 2012 Code)
   B.   Notice Applicability: Once a person has been notified regarding an existing nuisance on a particular property, such person will be considered notified with respect to any property owned or controlled by such person within the town. Notification will not be required prior to the issuance of a citation once a person has been previously notified two (2) times with respect to violations on any property under such person's ownership or control.
   C.   Abatement By Town: In the event a person responsible for the abatement of a nuisance fails to abate such nuisance within the time stated in the notice, or if such person cannot be located within a reasonable amount of time, the town may abate the nuisance either with town employees or by the hiring of private individuals, and may thereafter assess the costs of such abatement against the subject property or against the subject property by any legal means available. The town may proceed to enjoin such nuisance by legal action in addition to invoking any and all other penalties provided for in this chapter or other available legal remedies. (Ord. 160, 1-4-2005)
