9-4-1: COMMERCIAL DEVELOPMENT:
In order to check unnecessary sprawl and encroachment on agricultural land, as well as prevent an undue strain on available resources and the taxpayer's dollar, all commercial development shall conform to the following standards:
   A.   Effects On Town Systems And Services: No commercial development will be allowed without a thorough analysis of the effects of that development on the town water supply and distribution system, sewage collection and treatment, fire protection and streets. To accomplish this, the following information should be provided by the applicant:
      1.   An estimate of the amount of water required by the development on a daily basis;
      2.   An estimate of the amount and type of sewage effluent to be generated daily;
      3.   An estimate of the amount and type of solid waste to be generated daily;
      4.   A letter from the fire chief stating that the present fire protection service can adequately protect the proposed development.
   B.   Site Location: All commercial development shall be located on Main Street or in an orderly manner to the east of the town. A waiver will be granted only if sufficient evidence can be shown to the council that no adequate site is available in the above named area. An application may be rejected on the basis of lack of an adequate site.
   C.   Location Outside Urban Limit Line: All commercial developments located outside the urban limit line shall be provided with an individual water supply, water distribution and sewage disposal system separate from the town facilities. Approval of the water and sewage systems by the department of environmental quality must be presented.
   D.   Cost Of Expansions Or Upgrades: The applicant shall bear the full cost of any extension, expansion or upgrading of town facilities, including streets, necessitated to accommodate the development.
   E.   Connection To Water, Sewer Required: All commercial developments inside the urban limit line must be connected to town water and sewer.
   F.   Sewer Pretreatment: The council may require pretreatment of a commercial development's effluent before entering the town sewage system.
   G.   Off Street Parking: Any commercial development not located on Main Street must provide off street parking adequate for employees and customers.
   H.   Public Street Access: Safe access to public streets must be provided at all commercial developments.
   I.   Livestock Prohibited: No commercial developments shall be allowed inside the town limits which houses or sells livestock.
   J.   Setbacks: All structures of extensions or structures shall be at least ten feet (10') from all streets and three feet (3') from all property lines of alleyways. A distance of fifteen feet (15') from property lines is requested if the adjacent lot is solely residential.
   K.   Private Roads: Any street extension not indicated in the master plan from a commercial development to an existing public street shall be considered a private road and shall be maintained by the applicant. (1986 Code § 4-601)
