6-4-7: PRUNING; CORNER CLEARANCE:
Every owner of any tree overhanging any street, alley, sidewalk or right of way within the town shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view from any street intersection, and so that there shall be a clear space of eight feet (8') above the surface of the street, alley, sidewalk or right of way. Said owners shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a menace to the safety of the public. The town shall have the right to trim any tree or shrub on private property when it interferes with the proper spread of light along the street from a streetlight, or interferes with the visibility of any traffic control device or sign, such trimming is to be confined to the area immediately above the street, alley, sidewalk or right of way. The town will notify the owners of such trees in writing. Removal shall be done by said owners at their own expense within sixty (60) days after service of said notice. In the event of failure of the owners to comply with such notice, the town shall have the authority to remove said trees and charge the cost of removal to the owners. (Ord. 161, 1-4-2005)
