(A) This section shall regulate the installation of culverts and the enclosing of storm drains along streets and roadways within the corporate limits of the city.
(B) No landowner shall enclose any storm drain or ditch along the streets within the corporate limits of the city or install any culvert, pipe, tile or tube therein unless a permit has been issued for the same by the Storm Water Committee. An application for such permit shall be made on forms provided at the Building and Zoning office in City Hall.
(C) Any landowner who wishes to install a residential driveway culvert or field entrance on a street within the corporate limits of the city shall, prior to any installation, apply for a permit from the Storm Water Committee through the Building and Zoning office. Any permit which is issued shall specify the diameter of pipe required. The permit fee shall be $25.
(D) The landowner shall provide the Storm Water Committee through the Building and Zoning office with a detailed drawing of the proposed work specifying the length of the ditch to be enclosed, the location of inlets and any other relevant information. Any permit which is issued shall specify the diameter of pipe, the grades of the surface and the type of fill which shall be required. However, in the event further engineering is required at the location as determined by the Storm Water Committee, said Committee shall have the right to obtain an engineering report on the location in an effort to determine the appropriateness of the diameter and length of the culvert, pipe, tile or tube. An engineering report shall be at the expense of the Storm Water Utility.
(E) The installation of the culvert, pipe, tile or tube shall be performed according to the specifications set forth in the permit.
(F) The costs of the culvert, pipe, tile or tube shall be at the expense of the landowner except the city in its sole discretion may provide labor and equipment for the installation of any such driveway culverts or field entrances. All maintenance and cleaning of obstructions prior to the installation of the culvert and subsequent to the installation of such culvert shall be the responsibility of the landowner. If the storm drain or culvert becomes inadequate, or if it is improperly installed in violation of the permit, the Storm Water Committee may cause to be removed such storm drain or culvert which fronts the city streets within the corporate limits of the city if such drain remains obstructed.
(G) The diameter and length of the culvert, pipe, tile or tube allowed in the city street right-of-way within the corporate limits of the city shall be determined by the Storm Water Committee based upon a review of the location by the Storm Water Committee. This item shall be made of metal, PVC pipe or concrete.
(H) The Common Council shall have the right to change or amend the permit approval procedure and to delegate the responsibility to a particular employee by resolution. The Common Council hereby designates the Storm Water Committee to develop the permit forms and to approve and deny the permits described herein.
(I) The installation of culverts, pipes, tiles or tubes for any purpose other than a residential driveway or a field entrance shall be the total responsibility of the landowner without any involvement by the city.
