(A) A copy of the tariff is on file with the Clerk-Treasurer, and is also available at the TCED business office.
(B) The tariff has been approved by the Common Council, and the Common Council has continuing jurisdiction over the tariff in its entirety. The tariff, or any part thereof, may be revised, amended, or otherwise changed from time to time, and any changes, when approved by the Common Council, will supersede the present tariff.
(C) This subchapter sets forth the conditions under which service is to be rendered, and govern all classes of service to the extent applicable. In case of conflict between any provision of a rate schedule and/or rider and this subchapter, the provisions of the rate schedule and/or rider shall prevail.
(D) TCED shall have the right to enter into contracts for service or implement experimental programs under any rate schedule or rider, including programs establishing rates and charges based on market or average prices, price caps, index based prices, and prices that:
(1) Use performance based rewards or penalties, either related to or unrelated to TCED's return or property; and
(2) Are designed to promote efficiency in the rendering of retail energy services. TCED also shall have the right to enter into other contracts for service which may contain provisions not included in the tariff subject to the approval of the Utility Service Board.
