§ 35.07 DESIGNATION OF NON-SMOKING AREAS.
   (A)   Except for the rest room areas in each public building, all portions of City Hall, the fire station at 711 Humbolt Street and the newly constructed fire house at the intersection of 12th and Humbolt Streets, the sewage treatment plant, the electric utility plant, the water plant and the Street Department are hereby designated non-smoking areas.

   (B)   The warehouse portion of the operations building of the City Electric Department located at 5th and Fulton Streets in is hereby designated a smoking area and the rest room portion of the building is hereby designated a non-smoking area.

   (C)   All portions of the police station are hereby designated non-smoking areas, except for the kitchen area, which is hereby designated as a smoking area.
   (D)   Only that portion of the first floor of the high rise building at 1648 10th Street in the city occupied by the Executive Director and the staff of the City Housing Authority is hereby designated a non-smoking area.
   (E)   The community building of the City Housing Authority located at the corner of 16th and Franklin Streets is hereby designated a non-smoking area.
   (F)   The executive offices of the City Housing Authority located in the Spring Hill Apartments of the City Housing Authority located on Pestalozzi Street is hereby designated a non-smoking area.
   (G)   The entire indoor area of the Schergens Center located at 1140 31st Street is hereby designated a non-smoking area.
    (H)   The Board of Commissioners of the City Housing Authority shall cause conspicuous signs that read Smoking is Prohibited by State Law Except in Designated Smoking Areas to be posted in appropriate areas in each of the aforementioned buildings of the City Housing Authority.

   (I)   A violation of this section constitutes a Class C Infraction for which a judgment may be entered and a fine imposed.
   (J)   The attorney representing the city shall be entitled to reasonable attorney fees and reimbursement of all costs and expenses incurred in the enforcement of this section.
   (K)   All of City Hall Park is hereby designated as a tobacco-free area, including City Hall itself, the gazebo, and all other real estate within the park.
   (L)   All of Hagedorn Park (tennis courts, baseball field, swimming pool, men’s softball field, girls’ softball fields, Perry County Greenway and parking lot), Dennis Kress Memorial Park (Little League park), Kiwanis Park (Babe Ruth League park) and Roy Fenn Park (soccer fields) are hereby designated as tobacco-free areas including the entirety of each park itself, all buildings and structures on the grounds of each park, and all other real estate within each park.
