(A) The customer shall furnish TCED a satisfactory location for and provide safe access to TCED's meters and other equipment necessary to provide and measure service, and shall also furnish TCED the rights on, over or under the customer's premises necessary to install, operate and maintain TCED's other facilities required to supply service to the customer. TCED reserves the right to make the final decision as to the location of the meter on the customer's premises.
(B) When the customer is not the owner of the premises and/or of the adjacent premises, the customer shall furnish TCED with satisfactory easements for the location of TCED's facilities on the premises and/or on the adjacent premises. The customer must consult with TCED prior to obtaining the easements. TCED may, at its sole option, obtain the easements on the customer's behalf, provided that the customer agrees to reimburse TCED for expenses incurred.
(C) When TCED's transformers, meters or other facilities are to be installed indoors on the customer's premises, the customer shall furnish, without cost to TCED, suitable room or vault for housing the equipment; provided, however, that TCED shall reserve the right to make the final decision as to the location of the room or vault. The space shall meet the requirements of the National Electrical Code, any federal, state or local laws or regulations, and any policies of TCED in effect at the time of the installation.
(D) At it sole option, TCED may change the location of any or all of its facilities upon request of the customer, provided that:
(1) The change will not interfere with or jeopardize TCED's service either to the customer requesting the change or to other customers of TCED, and the customer may be required to bear the expense of the change.
(2) The customer shall provide reasonable protection from loss or damage to TCED property and may be liable to TCED in the event of loss or damage caused by the negligence of the customer or any agent or employee of the customer.
(E) The customer shall not disconnect, change connections or otherwise interfere with TCED's meters or other property, and shall be responsible to TCED for permitting anyone who is not an agent or employee of TCED to tamper with TCED's property.
(F) All facilities installed by TCED shall be and remain the property of TCED unless a contract expressly otherwise provides, and TCED shall operate and maintain its property.
(G) Properly authorized employees or agents of TCED shall have the right and the means to enter upon the customer's premises at all reasonable times for the purpose of meter reading, inspecting, testing, maintaining, operating or replacing any or all of TCED's property used in supplying any service to the customer.
(H) Upon termination of a contract or discontinuance of service, TCED shall have the right to remove all of its property from the customer's premises.
