§ 151.30 ESTABLISHMENT OF BOARD OF APPEALS AND RIGHT OF APPEAL.
   (A)   There is hereby created a Board of Appeals to hear appeals from decisions of the City Building Inspector. Such Board shall be appointed by the Mayor and shall consist of an odd number of persons, consisting of at least five, and such persons shall consist of those members of the City Plan Commission who do not hold elective office. In the event there are not enough such members of the Plan Commission to fill this Board of Appeals, then the Mayor may make such appointments to the Board as is necessary to complete the Board, provided however that no such Board members shall hold elective office. The terms of office of said Board of Appeals shall be for a period of one year, provided however that the initial terms of such Board members shall expire on December 31, 2005.
   (B)   All persons shall have the right to appeal the city building inspector's decision, first through the Board of Appeals established in the previous section of this section and then to the Fire Prevention and Building Safety Commission of Indiana in accordance with the provisions of I.C. 22-13-2-7 and I.C. 4-21.5-3-7.
