§ 130.02 STORAGE, SALE AND USE OF FIREWORKS PROHIBITED.
   (A)   No person shall use, ignite or discharge fireworks within the corporate limits of the City of Tell City, except during the following times:
      (1)   Between the hours of 5:00 p.m. and 11:30 p.m. on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9;
      (2)   Between the hours of 10:00 a.m. and 12:00 a.m. on July 4; and
      (3)   Between the hours of 10:00 a.m. on December 31 through 11:00 a.m. on January 1.
   (B)   No person shall use, ignite or discharge fireworks on any public street or in any public park, without the prior approval by the Board of Public Works and Safety, or in any public area or any city owned property within the corporate limits of the City of Tell City at any time.
   (C)   No person shall use, ignite or discharge fireworks in a manner which causes them to land upon the property owned or occupied by another person.
   (D)   Residents are permitted to use, ignite or discharge fireworks only on their own property or with permission of the property owner. The fireworks must land on the property from which they were used, ignited, or discharged.
   (E)   Nothing in this chapter shall prevent the fire chief, or his designee, from preventing the use of fireworks due to weather or any other safety concerns.
   (F)   Any violation of this chapter shall be punished by a fine of no more than $250 per incident, as well as any other penalty provided by the Code of Ordinances of the City of Tell City.
