§ 92.05 RULES AND REGULATIONS FOR USE OF GREENWOOD CEMETERY.
   Other rules and regulations for the Greenwood Cemetery are as follows:
   (A)   The transfer of any lots, parts of lots or plots to a third person shall be reported to the Office of the Clerk-Treasurer for record keeping before the purchaser shall be allowed to purchase the same.
   (B)    Anyone desiring to allow the interment of bodies into a lot for other than members of their own immediate family of the owners of the lot shall give written permission of the same, signed by the lot owner and presented to the Cemetery Sexton.
   (C)   Any person desiring to purchase lots shall contact the Cemetery Sexton, who shall give all information regarding prices and show plats and locations available for purchase.
   (D)   No fence of any kind shall be erected in Greenwood Cemetery for the purpose of enclosing any lot or grave.
   (E)   A landmark shall be placed at the head of each lot and shall have the lot number legibly inscribed on the top thereof, set flush with the surrounding ground, and shall be installed by the Cemetery Sexton or by cemetery personnel only. Stone or concrete coping that surround lots or graves are prohibited. Foundations for monuments must be at least two feet deep and should not be exposed above the ground on each side. After a grade has been established, the same shall not be altered and no lot shall be raised above the established grave. No foot stones or foot markers are permitted at any grave, and all monuments shall be placed at the head of the lot and in line with the landmark as set forth in this section. No grave slab shall be allowed on any lot except on those lots on which they exist at the time of the adoption of this chapter.
   (F)   The planting of trees, shrubs and flowers on cemetery lots is prohibited.
   (G)   The placing of any articles on the graves is prohibited, with the exception of the following:
      (1)   Flowers in vase containers securely attached to gravestones.
      (2)   Flowers attached to gravestone saddles.
      (3)   Solar lightings securely attached to gravestones.
      (4)   Figurines or similar articles, all of which must be securely attached to the gravestone, or placed on the gravestone in such a manner that they will not subject to being accidently moved from the gravestone.
      (5)   Provided, however, that no item may be attached to a gravestone which hinders mowing or other maintenance activities in the cemetery, which creates a safety hazard in the cemetery, or which is in poor taste.
      (6)   Items placed in violation of the restrictions in divisions (1) through (5) may be removed without notice.
      (7)   The restrictions in divisions (1) through (5) shall not apply to flags placed by service or veterans’ organizations for Memorial Day recognition, and also shall not apply to the first 72 hours after burial.
      (8)   The city shall not be responsible for loss or damage to any items attached to a gravestone.
   (H)   No one shall be allowed to break or remove any twig, plant, tree or flower in Greenwood Cemetery without the express written consent of the Cemetery Sexton. Anyone engaged in erecting monuments or other permanent structures on the grave site shall not place guy ropes, stay wires or support wires on to any tree, shrub or monument. Stone cutting shall not be permitted in the cemetery without first having obtained written permission from the Cemetery Sexton, and then only at places designated by the Cemetery Sexton.
   (I)   Any material or implements used for performing any work within cemetery and the earth or stones which may be left on the lot or any ground adjacent to any lot shall be removed without delay. If there is not compliance with this section, the same shall be removed by the Cemetery Sexton at the expense of the owner of the lots in question or the contractor, or whoever is responsible for failing to remove the same.
   (J)   Heavy hauling shall not be permitted in the Cemetery, except when permitted from the Cemetery Sexton. No person other than the Cemetery Sexton or designated representative shall dig any grave, excavate any earth, cut any sod, alter the grade of any lot or remove any earth therefrom or sod any grade or lot without first obtaining prior written consent from the Cemetery Sexton.
   (K)   Visitors are requested to stay on the walks and to refrain from walking over lots or standing or trampling on any graves. Receptacles are placed at convenient locations in the cemetery for trash, and all persons are requested to deposit trash in the receptacles. The depositing of trash anywhere in the cemetery is prohibited except in the above receptacles. The Sexton has the authority to remove dead and wilted flowers from graves no earlier than 72 hours after interment.
   (L)   All bodies to be interred, except for infants under the age of two years, shall be interred in either concrete or metal containers or any other containers such as fiberglass or plastic. The containers shall be made with sufficient strength to guarantee as long or a longer life than concrete or metal.
   (M)   Private mausoleums in Greenwood Cemetery have the following rules:
      (1)   Certain lots in Greenwood Cemetery have been established as sites for private mausoleums only, but shall be erected only above ground and are sold on a two-grave basis only. Private mausoleums shall not be erected upon any other cemetery property except in specifically designated areas.
      (2)   No private mausoleum shall be erected until a written design, with complete plans and specifications, are submitted to the Cemetery Committee and approval is granted by the Committee. The structure shall be composed of granite and metal, and all metal work shall be of a noncorrosive material.
      (3)   Walls of all private mausoleums shall measure at least four inches in thickness, and the roof shall be at least six inches in thickness. The floor shall be concrete reinforced with steel and tied into all sidewalls, creating a solid one-piece unit with no joints. A complete system of ventilation shall be provided.
      (4)   The position of the private mausoleum on the lot shall be determined by the Cemetery Committee upon its approval of the plans and specifications. Each lot size has been established as 12 feet in width and 12 feet in length. A person shall be allowed to only purchase the minimum number of lots necessary to accommodate the desired private mausoleums.
      (5)   All private mausoleums constructed within the cemetery shall be built so that all parts thereof may be readily examined by the State Board of Health or any other appropriate authorized health officer. The Cemetery Committee reserves the right to prohibit the erection and construction of any private mausoleum that in the committee's opinion is not suitable or desirable for the Greenwood Cemetery.
   (N)   All owners of private mausoleums that are erected and constructed in Greenwood Cemetery shall be solely responsible for the care and maintenance of the private mausoleums.
   (O)   Animals shall not be allowed within the cemetery area at any time. There is no exception to this prohibition for animals on leashes.
   (P)   The cemetery committee has the final approval and authority to enforce these rules, however, they may designate enforcement powers thereof to the Cemetery Sexton.
