(A) The Mayor shall appoint a committee of three from the membership of the Common Council, to be known as the Greenwood Cemetery Committee. It shall be the duty of the Cemetery Committee, by and with the advice and assistance of the Common Council, to exercise control of and care for Greenwood Cemetery and perform other duties in connection therewith, all as hereinafter provided. The members of the Committee shall serve until their successors are appointed and qualified.
(B) The Cemetery Committee shall, from time to time, make and cause to be made about the Cemetery any improvements and repairs as it may deem to be necessary and proper. Provided, however, that before the improvements or repairs costing in excess of $25 are contracted for, the same shall be reported to the Common Council for its approval. On or before the September 1 of each year, the Cemetery Committee shall make and file with the Clerk-Treasurer an estimate of all expenditures for cemetery purposes that may be needed for the succeeding fiscal year, and no expenditures shall be made or allowed unless there has been made an appropriation therefor by the Common Council.
(C) It shall be the duty of the Cemetery Committee to report to the Common Council at least quarterly as to the condition of Greenwood Cemetery, setting forth in each report the nature and kind of improvement and the cost thereof that was made since the filing of the last previous report.
(D) The Cemetery Committee shall have authority to make all reasonable rules and regulations as to the management and control of Greenwood Cemetery and the care and decoration of graves by friends and relatives of the dead as they may deem proper, and not inconsistent with this chapter.

(E) There is created the office of Sexton, and the Cemetery Committee, with the approval of the Common Council, shall appoint some suitable person to be Sexton of Greenwood Cemetery, who shall serve as the same during the pleasure of the Common Council and until his or her successor shall be appointed and qualified, and who shall receive an annual salary to be determined by the Council, which salary shall be in lieu of all services performed by the Sexton, and all fees for special and extra work shall be paid into the City Treasury and shall belong to the city. Before entering upon the duties of his or her office, the Sexton shall take and subscribe an oath that he or she will support the constitution of the United States and of the state, and that he or she will faithfully perform all the duties of his or her office. It shall be the duty of the Sexton to devote his or her entire time to the duties of his or her office, and he or she shall at all times be under the supervision and subject to the order of the Cemetery Committee. He or she shall perform any services about the cemetery as the Cemetery Committee may direct.

(F) The Sexton shall, on reasonable notice and at all times during the months of November, December, January, February, March and April, between the hours of 8:00 a.m. and 5:00 p.m., and during the months of May, June, July, August, September and October, between the hours of 6:00 a.m. and 7:00 p.m., unlock and open the gates of the cemetery for the ingress and egress of funeral processions, persons wishing to erect monuments or tombstones, and to visitors. At all other times the gates to the cemetery shall be securely locked, except in case of emergency, in which event the Sexton may unlock and admit persons to the cemetery at any hour. No person shall interfere with or interrupt the Sexton in the discharge of his or her duties, or remain in the cemetery after the hour of closing, except in case of emergency and by permission of the Sexton.

(G) The Sexton shall not dig any grave in the cemetery until a certificate is produced from the Clerk-Treasurer stating the name, age and sex of the deceased, and the amount paid for the certificate. Upon receipt of the certificate, the person applying therefor shall pay the Clerk-Treasurer the sum of $5 for the certificate for a person under the age of eight years, and $10 for a person over the age of eight years. However, owners of lots shall be entitled to a reduction of $1 on each certificate, and that the Cemetery Committee may authorize the issuance of a certificate without charge, to persons who are too poor to pay for the same. For the use of the vault a charge of $3 shall be made for any period of time not exceeding ten days. The Sexton shall not disinter, nor shall any person disinter, any dead body in the cemetery, except that a permit therefor be first obtained from the Clerk-Treasurer. The cost of the permit shall be $8 for a person under the age of eight years, and $10 for a person over the age of eight years.

(H) The Cemetery Committee shall, from time to time, cause certain portions of Greenwood Cemetery to be laid out in lots 16 feet square, fronting on streets six feet wide and separated by alleys two feet wide, in conformity to plat heretofore made and recorded. The Cemetery Committee shall, from time to time, establish a selling price for each lot so laid out, and any person so desiring to purchase any of these lots shall pay the Clerk-Treasurer the price therefor so fixed by the Cemetery Committee. Upon the payment of the price, the Clerk-Treasurer shall issue to the person a certificate of purchase, and the certificate shall contain the provision that the lot is sold for burial purpose and upon condition that the owner of the lot will comply with the rules and regulations of the Cemetery Committee and the ordinances of the city in relation to Greenwood Cemetery. No lot shall be sold except that it be upon the conditions aforesaid.
(I) All moneys and revenues for cemetery purposes shall be paid to the Clerk-Treasurer, and all payments out of the Cemetery Fund shall be made only upon order or warrant duly issued therefor in accordance with the laws of the state.
(J) The Sexton of Greenwood Cemetery shall be clothed with police powers of an ordinary police officer, and it is hereby made his or her duty to arrest any person who may be found in Greenwood Cemetery violating any of the provisions of this chapter or the law of the land, and forthwith bring the person before the Mayor for trial.
(K) It shall be deemed a violation of this chapter for any person to violate any of the rules and regulations for Greenwood Cemetery established by the Cemetery Committee.
