(A) Allowable operation.
(1) Off road vehicles and golf carts may be operated on city streets, so long as said vehicles have non-straddle seats, and are equipped with safety belts for operators and passengers.
(2) Off road vehicles and golf carts may be operated only during daylight hours commonly referred to as sunrise to sunset as determined by the National Oceanic and Atmospheric Administration, unless said vehicles are equipped with properly functioning headlights, taillights and are otherwise authorized under the Indiana Code for operation upon public highways.
(3) A person operating an off road vehicle or a golf cart upon a city street has all the rights and duties concerning traffic regulations that are applicable to a person who drives a vehicle, in addition to the conditions set forth in this chapter.
(4) Off road vehicles and golf carts operated on city streets must be equipped with a muffler in good working condition.
(B) Prohibited operation.
(1) Off road vehicles and golf carts may not be operated on sidewalks or other public walkways.
(2) Off road vehicles and golf carts may not carry more passengers than said vehicles are designed to carry and must be equipped with seat belts for operators and passengers.
(3) Off road vehicles and golf carts may not be operated without a slow-moving vehicle emblem affixed to the rear portion of the off road vehicle or golf cart.
(4) Off road vehicles and golf carts may not be operated by a person that does not possess a valid Indiana driver’s license or a driver’s license recognized by the State of Indiana for the legal operation of vehicles.
(5) Off road vehicles and golf carts may not be operated by a person that cannot provide proof of financial responsibility, such as proof of insurance.
(6) Off road vehicles or golf carts with saddle style seats that must be straddled by the operator shall not be operated on city streets.
