The following words and phrases when used in this ordinance shall have the meanings respectively ascribed to them as listed unless the context otherwise indicates.
ABANDONMENT. The voluntary relinquishment of possession by the owner of any animal with the intention of terminating ownership but without vesting it in any other person.
ANIMAL. All members of the canine, feline, rodent families, and reptiles. Also any animal domestic, domesticated, or wild, the keeping or harboring of which might violate any section hereof. Provided, however, that nothing in this chapter shall apply to fish.
AT LARGE. Any animal found off the owner's premises, and with regard to dogs is not restrained by a leash or chain or is not under the owner's immediate control. The definition of AT LARGE does not apply to dogs located within Tell City's dog park known as “Central Bark.”
DISEASED ANIMALS. An animal with a contagious or infectious disease.
KENNEL. Any premises or portions thereof on which dogs, cats, or other household domestic animals are maintained, boarded, bred, or cared for, in return for remuneration, or are kept for the purpose of sale. The definition of KENNEL shall not apply to any premises being used by a doctor of veterinary medicine licensed by the State of Indiana to practice veterinary medicine, in conjunction with any business operation of said doctor of veterinary medicine conducted on the premises of said doctor of veterinary medicine practice.
NUISANCE. As used in this chapter shall mean a condition which arises by an animal emitting noises consistently so as to disturb the peace and quiet of the neighborhood, or which consistently or at intervals, chases bicycles, automobiles or pedestrians on the streets and sidewalks of the city, or any other condition created by an animal which would destroy or deface shrubbery, gardens, lawns, or flowers, or which might result in the general discomfort of citizens in the city where such animal is harbored.
OWNER. Any person or entity having a right of property in an animal, or who keeps or harbors an animal, or who has in it, his, or her care or acts as its custodian, or who knowingly permits an animal to remain on or about any premises occupied by him, or her or it.
VICIOUS ANIMAL. Any animal that without one provocation has been known to have scratched or bitten a human being, or who promiscuously attacks other animals.
