5.14.160: TEMPORARY FIREWORKS STANDS:
   A.   It is unlawful for any person to engage in the business of selling fireworks without first obtaining a license from the city to do so for each location.
   B.   All applications to sell fireworks must include insurance certificates evidencing public liability insurance coverage in the amount of two hundred thousand dollars/four hundred thousand dollars ($200,000.00/$400,000.00), and property damage insurance coverage in the amount of two hundred thousand dollars ($200,000.00), and such certificates shall designate the city as an additional insured, and include certificates evidencing products liability insurance in an amount not less than one million dollars ($1,000,000.00) per occurrence.
   C.   Each applicant for a temporary fireworks stand shall file with the city a cash bond or irrevocable letter of credit, made payable to the city, in the amount of three hundred fifty dollars ($350.00) for each location. Such bond or irrevocable letter of credit shall assure compliance with the provisions of this section, including, but not limited to, the removal of the stand and the cleaning of the site where it was located. Such bond or irrevocable letter of credit may be forfeited when damage has resulted.
   D.   All persons or entities selling fireworks in the city of Taylorsville shall conform to the following general requirements:
      1.   Sale and possession of fireworks are limited to those listed and approved by the Utah state fire marshal.
      2.   All fireworks retail sales locations shall be under the direct supervision of a responsible person who is eighteen (18) years of age or older.
      3.   Fireworks cannot be sold to a person under the age of sixteen (16) unless accompanied by an adult.
      4.   No temporary fireworks stand shall be within twenty five feet (25') of any building, structure, or any other temporary fireworks stand or within fifty feet (50') of any gasoline pump, or gasoline dispensing service, or LPG tank or dispensing device.
      5.   All weeds and combustible materials shall be cleared from within twenty five feet (25') of any temporary fireworks stand.
      6.   All sale locations must have on premises at least one "2A10BC" rated fire extinguisher.
      7.   Temporary fireworks stands less than one hundred twenty (120) square feet need not comply with the provisions of the uniform building code, but all such stands shall be erected in a manner that will reasonably assure the safety of occupants and patrons.
      8.   Temporary fireworks stands one hundred twenty (120) square feet or larger must conform to all fire and building code requirements.
      9.   Lighting of temporary fireworks stands shall be by electric light only and all temporary power shall comply with the applicable electrical code.
      10.   Signs bearing the message "Discharge of Fireworks Prohibited Within One Hundred Feet of this Location" and "Smoking Prohibited Within Twenty Five Feet of this Location" in letters at least three inches (3") tall shall be attached and conspicuously displayed on all four (4) sides of the temporary fireworks stand.
      11.   Fireworks may not be stored in residences or attached garages.
      12.   The storage or selling of fireworks shall not by its presence, create a distinct hazard to any person or property.
      13.   Fireworks may only be sold from June 20 through July 25, and December 20 through January 2, and fifteen (15) days before and on Chinese New Year.
      14.   Fireworks may be discharged three (3) days prior to, or on the day of, and three (3) days following July 4, July 24, January 1, and the Chinese New Year.
      15.   Display of fireworks inside a building or temporary fireworks stand shall be located to ensure constant visual supervision.
      16.   Temporary fireworks sales in permanent structures must be separated from flammable and combustible gases, liquids, and solids by at least fifty feet (50').
      17.   Temporary fireworks sales in permanent structures must be located in such a manner as to not impede egress from the building. (Ord. 05-14, 4-6-2005)
