In case of the death of a plot owner, the town will recognize the rights of the surviving spouse or next of kin, insofar as the town is able to ascertain who such parties are. The town shall not be responsible for errors committed, unless the town is promptly notified of the death of the plot owner and given a certificate designating the surviving spouse or next of kin to whom the right of the plot owner has passed by descent, request, or devise.
