For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BOROUGH. The Borough of Tatamy.
PERMIT. The form that must be obtained, completed and submitted together with the respective fee to the Borough Secretary/Treasurer prior to conducting a yard sale.
PERSON. Any natural person or persons, association, partnership, firm, corporation, civic group, school group, church group, charitable or fraternal organization, and other nonprofit organization or other entity.
PERSONAL PROPERTY. Tangible property which is owned, utilized and maintained by an individual or members of a residence or acquired in the normal course of living in or maintaining a residence, such as, but not limited to, household items, clothing, tools, toys, recreation equipment or other used or secondhand items normally found in and about the home. PERSONAL PROPERTY shall not include any tangible property purchased or acquired for the purpose of resale during the yard sale.
RESIDENTIAL PROPERTY. Includes, but not limited to, the residential properties themselves and any residence, garage, barn, home, shed, lawn, porch or yard attached to or serving any residential property.
YARD SALE. Any public sale of personal property on residential property by any person whether accomplished by direct sale or auction.
